End User License Agreement (EULA)

Important: This End User License Agreement ("Agreement") is a legal agreement between you and Apollo Street Company d/b/a Call A Monster for the Call A Monster mobile application. By downloading, installing, or using this App, you agree to be bound by the terms of this Agreement.

1. License Grant

Apollo Street Company d/b/a Call A Monster ("Licensor") grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Call A Monster application ("App") for personal, non-commercial purposes strictly in accordance with this Agreement.

2. License Scope

You MAY:

Install the App on devices you own or control
Use the App for personal entertainment purposes
Allow children ages 2-10 to use the App under your direct supervision
Access all features available in your purchased version

You MAY NOT:

Copy, modify, or create derivative works of the App
Reverse engineer, decompile, or disassemble the App
Rent, lease, lend, sell, redistribute, or sublicense the App
Use the App for commercial purposes
Remove or alter any proprietary notices or labels
Use the App to harass, harm, or frighten children inappropriately
Circumvent any security or access controls

3. Intellectual Property Rights

The App and all rights, title, and interest in and to the App, including all intellectual property rights, are and will remain the exclusive property of Apollo Street Company. This Agreement does not convey any ownership rights to you.

All trademarks, service marks, trade names, logos, and other branding features ("Marks") displayed in the App are the property of Apollo Street Company or their respective owners.

4. User Content and Data

The App operates primarily offline. Any preferences, settings, or customizations you create within the App remain on your device. You retain all rights to any content you create, but grant us a license to use such content solely to provide and improve the App services.

5. Age Restrictions and Parental Responsibility

Parental Supervision Required:

The App is designed for children ages 2-10
Adult supervision is MANDATORY during use
Parents/guardians are fully responsible for monitoring use
You must ensure content is appropriate for your child
Immediately discontinue use if child shows distress

6. Updates and Modifications

Licensor may provide updates, upgrades, or new versions of the App. These will be subject to this Agreement unless accompanied by a separate license agreement. Licensor reserves the right to modify or discontinue the App at any time without notice.

7. Privacy and Data Collection

Use of the App is subject to our Privacy Policy available at Privacy Policy. The App complies with COPPA requirements for children's applications.

8. Warranty Disclaimer

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. LICENSOR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. LICENSOR DOES NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED.

9. Limitation of Liability

IN NO EVENT SHALL APOLLO STREET COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, REGARDLESS OF THE THEORY OF LIABILITY.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless Apollo Street Company and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising out of or related to your use of the App or violation of this Agreement.

11. Termination

This license is effective until terminated. Your rights under this license will terminate automatically without notice if you fail to comply with any term of this Agreement. Upon termination, you must cease all use of the App and destroy all copies.

12. Governing Law and Dispute Resolution

This Agreement is governed by the laws of the State of California, United States, without regard to its conflict of law principles. Any disputes arising under this Agreement shall be resolved through binding arbitration in California, except where prohibited by law.

13. Severability

If any provision of this Agreement is held to be unenforceable, the remaining provisions will continue in full force and effect.

14. Entire Agreement

This Agreement, together with our Terms of Service and Privacy Policy, constitutes the entire agreement between you and Apollo Street Company regarding the App and supersedes all prior agreements and understandings.

Acknowledgment: BY DOWNLOADING, INSTALLING, OR USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT, AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS.
